If you offer a group health plan with prescription drug benefits, you must send all participants who are also covered by Medicare either a Notice of Creditable Coverage or a Notice of Non-Creditable Coverage by November 15th 2009. This is one of two annual notice requirements imposed by the Centers for Medicare and Medicaid Services (CMS), which also mandates that you notify them (CMS) about your plan’s creditable coverage status no later than the 60th day after the start of each plan year.
